Terms Of Service
Last updated:
PleasePlay.Music is owned and operated by Pat Dryburgh. These terms govern your use of the application, including song requests, newsletter Boosts, act accounts, song catalogues, show schedules, reports, and connected services. “We,” “us,” and “our” mean Pat Dryburgh operating PleasePlay.Music. “Act” means a band, duo, or solo performer using the service.
By submitting a song request, signing in, or creating or joining an act after being shown a link to these terms, you agree to them. If you do not agree, do not take those actions. You must be legally able to enter this agreement or have a parent or legal guardian who agrees to it on your behalf and supervises your use. If you act on behalf of a legal organization, you confirm that you have authority to bind it.
Questions about these terms can be sent to ppm@patdryburgh.com.
Song Requests And Live Shows
PleasePlay.Music lets audiences browse and search an act’s song catalogue, request songs for free, and see live request activity. Act members manage the catalogue and request queue. A song request is a suggestion, not a promise that a song will be played. Acts decide what to perform and in what order. Request counts and Boosts do not guarantee performance or a place in the set, and requests, live updates, or notifications may be delayed or fail to arrive.
Acts control their catalogues, request availability, and displayed show information. Members can open or close requests, use show schedules to automate availability and queue resets, mark songs as played, make them available again, or reset the queue. A song marked as played is unavailable for further requests until a member makes it available again or the queue is reset. Show times and request availability can change, and information imported from external feeds may be incomplete or out of date. Check important event details with the act or venue.
The service does not sell tickets, book performers, stream music, or grant permission to perform or otherwise use a musical work. Arrangements with an act or venue are separate from these terms.
Request Priority And Newsletter Boosts
Each listener’s accepted song request adds one Boost to that song. Where an act offers newsletter signup, an active subscriber can assign the number of extra Boosts displayed on the request form to one request per show. The act chooses that value. The queue ranks songs by Boosts; ties go to more listeners, then the earlier request. These rankings help the act understand audience preferences but do not determine what it must play.
Newsletter Boosts are added only after the connected email service confirms an active subscription and while the selected song is still eligible. Existing subscribers can verify their subscription; new subscribers may need to confirm an email first. The displayed bonus is limited to one request per subscription per show and cannot be claimed again after that song is played. Verification and confirmation may be delayed or unavailable, and a subscription does not guarantee Boosts before a song is played or a show ends.
Optional Pledges And Tips
Song requests are free. Where an act enables tips, you can optionally pledge an amount in the currency shown on the pledge form through Stripe. Stripe places a temporary authorization; authorized pledges add Boosts at the rate shown on the form. The currency and Boost rate stay fixed for the show. The pledge is collected when an act member marks the song played, including within 24 hours after the show ends. Unplayed pledges are released after that 24-hour window. Payment authorizations that have already expired or been released cannot be collected. Your bank controls when a released hold disappears from your statement. A pledge does not guarantee a performance.
After a song is played, you may instead leave a thank-you tip, which is collected after checkout and adds no Boosts. Payment confirmation can be delayed; returning from checkout does not by itself prove a payment was completed or cancelled. Your request confirmation displays the recorded status and a receipt link when available.
Payments go to the act’s connected Stripe account, and Stripe’s fees apply. Act members must mark songs played only after performing them, within 24 hours after the show ends to collect pledges, and before resetting the queue. Contact the act or Pat about payment questions, mistaken charges, or refunds. The act manages refunds through Stripe. Stripe has its own terms and privacy practices.
Accounts, Invitations, And Shared Access
Audience members do not need an account to request a song. Act members sign in with Google, and new accounts and act memberships require valid invitations. Use your own account, protect your sign-in credentials, and notify Pat promptly if you suspect unauthorized access.
Only create or join an act you are authorized to manage. Every member of an act has equal management access. Members can change settings and integrations, manage the song library, artist photos, shows, requests, and reports, invite people, revoke invitations, and remove members. Other members can see your name and email address. Agree within your act on who should have access and which changes they may make.
Membership invitation links can be used by multiple people and work when forwarded until they expire or are revoked. Share them only with people you trust to manage the act. Removing a member also revokes invitations they created, but another valid invitation may let them rejoin. Review and revoke other outstanding invitations when necessary. The application does not allow removal of the act’s last member; contact Pat if you need help closing an act.
Your Content And Permissions
You retain any rights you hold in information and content you provide or connect, such as act names, logos, icons, artist photos, song information, website and social links, and show details. You must have the rights and permissions needed to supply that material, authorize its import, and make it available through the service. Keep it accurate, and do not provide private information that you are not authorized to share.
For artist photos or other third-party material you select, follow the applicable licence and provide the required photographer credit, licence information, and source links. A photo being publicly accessible or available through an external source does not by itself grant permission to use it. Displayed images, credits, and links do not imply an artist’s endorsement of an act or the service.
You give us a non-exclusive, worldwide, royalty-free permission to fetch, store, copy, format, and display that content only as needed to operate the service and subject to any applicable third-party licence. This includes making act branding, artist photos and credits, song information, links, and displayed show details available on public act pages. It does not transfer ownership of your content or grant us a separate right to sell it. The permission ends when the content is removed from the service, except to the extent needed for retained backups or records required by law.
We and our licensors retain our rights in the application and its branding. We permit you to use the service for its intended purposes under these terms. Separate open-source licences, where applicable, govern rights granted under those licences. Using the application does not give you ownership of another act’s content or permission to imply its endorsement.
Report suspected infringement to ppm@patdryburgh.com with the relevant page, a description of the material and your rights, and contact information so we can investigate.
Acceptable Use
Use the service lawfully and respect other users. Do not impersonate an act or another person, submit unlawful or infringing material, harass people, send spam, or use someone else’s email address to subscribe or claim newsletter Boosts without permission. Do not access accounts or act data without authorization, expose credentials, introduce malicious code, interfere with the service, or bypass access controls, request limits, duplicate-request protections, or newsletter bonus limits. Do not use automated requests or multiple browser identities to manipulate song counts or Boosts or overwhelm the application.
Optional Marketing Emails And Privacy
You can request songs without providing an email address or agreeing to marketing. After a successful request, an act may offer optional mailing-list signup through Kit or Mailchimp. An email address is required only if you choose to sign up or verify an existing subscription for newsletter Boosts. Agreeing to these terms does not subscribe you to any mailing list, and a later newsletter signup or verification failure does not remove an already accepted song request.
Our Privacy Policy explains how we handle personal information and your choices. If you choose signup or subscription verification, your email address is sent to the act’s selected Kit or Mailchimp account to check your subscription. A Mailchimp signup can also send the details you enter in the public audience fields shown on the form. If the address is not actively subscribed, this action can start signup or confirmation through that provider. Confirmation depends on the provider and the act’s settings. We associate newsletter activity with the show and requested songs for reporting and send show and song tags to the selected email service so the act can organize its list.
The act controls its mailing list and messages. Declining a later signup, clearing browser data, or disconnecting an email service does not unsubscribe an existing subscription. Use the unsubscribe link in the act’s emails or contact the act; Pat can help identify the relevant act.
If you manage an act’s mailing list, you must comply with the privacy and anti-spam laws that apply to you and your recipients. Provide required notices, obtain and keep evidence of any required consent, identify the sender, include required contact information and an effective unsubscribe method, and honour unsubscribe and privacy requests. Use subscriber information only for disclosed, lawful purposes. Configure your email service’s forms or audiences, fields, tags, confirmation settings, and email tracking accordingly. The signup feature alone does not establish that your email practices comply with the law. These responsibilities do not remove our own obligations for information we handle.
Connected Services And Notifications
The application uses services such as Google for sign-in, BandHelper or other configured feeds for song and show information, external sources for artist information and photos, Kit or Mailchimp for optional mailing-list signup and subscription verification, and browser push services for optional member notifications. Those services have their own terms, privacy practices, availability, and possible charges. Links to act websites, social networks, maps, or photo sources take you to services operated by others.
Connect only accounts and feeds you are authorized to use. Connecting them authorizes us to make the requests needed for the features you enable. Protect private feed URLs and remember that other act members can manage the connection. Providers may change their services, impose limits, or revoke access, which may interrupt a feature.
A successful Kit disconnection revokes its authorization and removes the locally stored connection tokens; a failed disconnection may require another attempt. A Mailchimp disconnection removes this act’s locally stored connection; authorization can be revoked separately in Mailchimp’s authorized applications. Disconnecting either service does not remove existing subscribers. A signup can reach the selected email service even if a later step or confirmation in the application fails. Notification delivery also depends on browser permissions, devices, and providers. Signing out alone does not disable push notifications; manage that permission in your browser or device settings.
Show Reports And Request History
Act members can view retained request activity and reports of song popularity and newsletter signups across shows. Reports can use shows imported from a configured schedule or shows and request windows saved by members. They reflect activity recorded by the application, not a verified count of people attending a show. Newsletter signup figures can include existing subscribers and people awaiting confirmation; they are not a count of new, confirmed subscribers. Reports do not display audience email addresses. Older activity may be incomplete or have no newsletter information.
Fees, Availability, And Stored Information
We currently charge no fee to use PleasePlay.Music. You are responsible for your own internet, device, and third-party service costs. If we introduce paid features, we will explain the price and applicable terms and obtain your agreement before charging you.
We may maintain, update, change, or discontinue features. We will give reasonable advance notice of a material reduction or discontinuation where practical; urgent security, legal, or provider issues may require immediate action. The service has no guaranteed uptime or support response time.
We schedule database backups to help recover the service, but cannot guarantee that every change will be saved, that individual records can be restored on request, or that recovery will be completed within a particular time.
Keep your own copies of information important to your act. Resetting the live queue clears its counts and played-song status while retaining request history and show reports. Making a played song available again clears its current request count without erasing its history. Closing requests pauses new song requests; it does not clear the queue. Ending a show closes its request round and further newsletter Boosts without deleting reporting history. Saved reports can remain after a show leaves an external feed. Retention, deletion requests, and the limits of backup deletion are described in the Privacy Policy.
Stopping Use And Access Restrictions
You can stop using the service at any time. Act members can leave an act if another member remains. Contact Pat to request account deletion or help closing an act. Leaving an act, signing out, or disconnecting Google does not itself delete your PleasePlay.Music account or data held by another service.
We may restrict access, suspend an account or act, or remove content when reasonably necessary to address a breach of these terms, unauthorized access, harm to users or the service, or a legal obligation. Where practical and lawful, we will explain the reason and provide an opportunity to address it. We may act immediately where delay would create a risk. Contact Pat if you believe a restriction was mistaken. Personal information remains subject to the Privacy Policy and applicable law.
Service Warranties And Liability
To the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties of merchantability or fitness for a particular purpose. We do not guarantee that it will be uninterrupted, error-free, completely secure, or suitable for every show or workflow, or that external information will be accurate.
To the extent permitted by law, Pat Dryburgh is not liable under these terms for indirect or consequential losses arising from use of, or inability to use, the service, including lost profits, opportunities, or data where those losses are indirect or consequential. This applies whether a claim is based on contract, negligence, or another legal basis.
These exclusions do not apply to fraud, wilful misconduct, gross negligence, or any liability that cannot lawfully be excluded or limited. Nothing in these terms takes away mandatory consumer protections, privacy rights, statutory warranties, or remedies available under applicable law.
Disputes And Changes To These Terms
If a dispute arises, you may contact Pat at ppm@patdryburgh.com so we can try to resolve it. Contacting us is not a prerequisite to exercising your legal rights and does not extend any legal deadline. These terms do not require private arbitration or prevent you from bringing a matter before a court or regulator with jurisdiction under applicable law.
We may update these terms and will post the revised version with an updated date. For material changes, we will give reasonable advance notice through the application or another appropriate channel and seek renewed agreement where required by law. Changes apply prospectively. If you do not agree to a change, you may stop using the affected service and contact Pat about your account and information.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. Provisions concerning ownership, responsibility for past use, liability, and disputes continue to apply after use ends to the extent needed to give them effect.
